WGA - AMPTP - Yahoo! - Microsoft - MediaBytes February 11, 2 THE WGA and the AMPTP formed a tentative three-year agreement that gives writers 2% of the producer's gross for Internet streaming. For download rentals the scribes will get 1.2% of distributor's gross and for download purchases they will receive up to .7%. According to Variety, TV showrunners will return to work today and writers are expected to return on Wednesday after voting to officially end the strike. Details of the deal can be found here. YAHOO is expected to officially reject MICROSOFT's takeover bid today, claiming that the $44 billion offer "massively undervalues" the company. Microsoft will have to decide if it should increase its offer or stick to it and rally the support of shareholders. Meanwhile, The Times of London claims that Yahoo has restarted merger talks with AOL. The Academy of Television Arts & Sciences is expected to announce that online content will be considered for existing Primetime Emmy categories. A sparse announcement is currently hosted on the ATAS site. CENTRIS estimates that almost 6 million TV sets will be left without a signal after the transition to digital television next year. The market research firm conducted a study that took into account landscape and geographic barriers that may block digital signals. The company warns that a large number of households may need improved antennas to receive the digital signals. CNN will fully embrace user-generated news this week, using iReport.com to display all user submissions. Until now iReport's UGC content has been filtered by editors with 10% of the content selected for use on CNN.com or the cable channel. The new iReport site will take a YouTube approach, where any and all submitted content is published for the world to see. CBS will broadcast all March Madness games through the Final Four online without local blackouts. The online broadcasts will feature an improved, widescreen resolution (while falling short of HD). Coca Cola, AT&T and Pontiac will sponsor the online games. MOTOROLA and NORTEL may combine their wireless phone infrastructure businesses into one entity worth approximately $10 billion. Combined with Motorola's planned divestiture of its handset business, the move would result in a greatly shrunken Motorola. Talks are one month old and reportedly heating up. DGA - AMPTP - Time Warner Cable - comScore - Yahoo - OpenID THE DGA has reached a three-year deal with the AMPTP that delivers significant new media advances. The Guild will have jurisdiction over content created for the web and residuals for downloads will be based on distributors' gross instead of the 20% of producer's gross used under the home video agreement. Directors will receive .3% of distributors' gross for downloads and .7% when downloads exceed 100,000. They will also receive 3% of the applicable residual for Internet streams during the first 26 weeks of a release. The WGA will be reviewing the deal to determine if talks should resumes for writers. TIME WARNER CABLE is planning to experiment with new variable pricing for Internet access, charging users based on the amount of data downloaded. Tiered data packages will be available similar to the way a phone plan is purchased. A company spokesman says 5% of users take up 50% of network capacity by downloading large amounts of data. Trials are expected to begin in Q2. COMSCORE has released its latest online video stats, revealing that Americans viewed 9.5 billion online videos during November. Google video sites delivered 31% of all videos and 41.8% of the 138 million viewers. The average YouTube viewer watched 39 videos during the month. MySpace, the second top video site, saw an average of only 9 videos per viewer. The average amount of monthly viewing increased from 3 hours to 3.25 hours. YAHOO will adopt the OpenID standard, bringing its 248 million members to the single username and login initiative. The move more than triples OpenID membership, which now totals 368 million. Yahoo users will now be able to login to non-Yahoo sites that use OpenID, avoiding multiple registrations and multiple usernames. Microsoft and Google recently announced plans to adopt the standard. DOUG LIMAN has started Jackson Bites, a new digital production company that will create content for the web, set-top boxes, mobile phones and more. The successful Swingers and Bourne Identity director has taken funding from investors and already signed a deal with the WGA to use striking writers. Google - Microsoft - Yahoo - WGA - AMPTP - ESPN - MediaBytes GOOGLE CEO Eric Schmidt phoned YAHOO's Jerry Yang on Friday to offer some sort of help in avoiding a MICROSOFT takeover. No details of the call have been released but there is speculation that it could involve Yahoo outsourcing its search business to Google. Google has posted a reaction to the takeover bid on its blog, saying a combined Microsoft-Yahoo will threaten the openness and innovation of the Internet. Microsoft's General Counsel responded by saying the deal would "create a more competitive marketplace." Meanwhile, the House of Representatives has scheduled a hearing on the issue for this Friday. CABLEVISION is expected to officially announce a new service that offers a combination of DVD purchasing and instant VOD access to content. Viewers will be able to order a DVD through a VOD channel on the same day it hits stores and then begin watching the feature immediately. The service is a partnership with Popcorn Home Entertainment. Content will be available from Warner Bros. and Universal. THE WGA and the AMPTP have reportedly made major breakthroughs in negotiation talks and an agreement is expected soon. Streaming rights have been agreed upon and lawyers are drafting contracts, which will be reviewed by the negotiating committees. However, the Guild presidents have told its members that no deal is firmly in place yet and that picketing must continue. ESPN will slightly open the gate to ESPN 360's walled garden, offering free access to users in the .edu and .mil domains and potentially doubling its audience. The site offers live, online streaming of full-length sporting events. Until now it has only been available to users whose ISP's have cut deals with ESPN. The company is hoping to migrate the cable business model to the web but this may be a sign that this approach is not working. NATIONAL GEOGRAPHIC is launching a reorganized broadband video site with multiple genre channels. 1500 clips will be offered with ad support. Most clips will be short, with a new long video added each week. The reorganization comes after Nation Geographic found much higher activity on the NGC Wild site, which uses the genre model.
