UK debt collection agencies and how to handle them ***UPDATE! Sorry if I confused anybody, but the order I would generally go in is to issue the Credit agreement request FIRST, then go down the formal complaint route. Some may prefer to enclose the agreement and complaints-procedure requests in the same letter - everybody's different. I should have made this a lot clearer than I did, and apologise for not spotting it sooner. However, I need to re-embellish the point of making NO admission of debt at ANY point to these people - it may come back to haunt you, and you don't have to answer anything to them anyway. *** In my previous messages, I have highlighted the dishonest and sometimes even illegal actions of private collection agencies. Apart from the corrupt UK government's active sponsorship of the industry in general -- and their forthcoming proposal to allocate state debts to Intrum Justitia (a company that shouldn't be trusted to mop toilet floors!) - I am attempting to highlight how uncontrolled, poorly-monitored an industry it really is. Many such companies don't hold a credit licence, and many are not registered with Companies House. More to the point, this industry is directly responsible for aggravating stress, depression, desperation, family break-ups, and even suicide in some cases. And why should you or me actually subside all this? But - don't be frightened -- they have no real powers of their own, are totally irrelevant, and can easily be subdued, and here's how. Not only that, but you can very easily turn the situation around on its head and actually cost THEM money without cost to you, apart from a few minutes of your time. If you've ever been a victim of identity fraud, unwarranted harassment, or just plain old mistaken identity, what follows is what you should do to counter it. The companies concerned won't like it, but who cares what they think? What matters is you, not some company that tries to rob your hard-earned with threats and bullshit. There are more important points that I did not have time to highlight in the speech. 1) You should always start your initial letter with 'I do not acknowledge any debt to your company'. Even if you do owe a debt, remember again that it's the original creditor that needs paying, not them. They cannot prevent you from doing so, and if you do choose this alternative, you don't have to explain yourself to them! Remember also that a collection agency may be quoting an amount surpassing that of what the original creditor have already told you previously. One more reason NOT to deal with an agency. 2) If you do make/receive a phone call from an agency, get the name of the person working for the company. But bear in mind that some of the less reputable collection agencies, such as McKenzie Hall, do use fake names. 3) More often than not, as the 40th day draws near, you will receive a letter from them stating 'we are no longer handling this account and are returning it to our client'. Translated, this means that the agency cannot obtain the information you've asked them for and are running scared in case you make a formal complaint. If this happens, make a formal complaint anyway -- they have after all, shook you up with their letter, and that warrants a complaint in itself. If nothing else, this is further assurance that you won't hear from that agency again. 4) You may receive two letters from two different agencies at or around the same time in pursuit of the same debt. It is unlawful for two agencies to be simultaneously persuing the same debt. 5) A debt you may be paying already may end up being passed to another agency, who will then send a letter threatening further action for non-payment. Remember that even if you do pay an agency as regular as clockwork, it in no way means the threat letters will stop. This usually happens when debt portfolios are sold on other agencies by the original creditor. This segues off neatly into the scenario highlighted in point 4. 6) Have draft letters already prepared for any scenario I have highlighted. 7) There are cases where people make an arrangement with a collection agency whereupon they 'negotiate' a percentage lump sum to 'get rid of' the debt. Many do this in order to remove defaults from their credit reports. Remember that once the default is there, it will stay there and even if the defaulted debt has since been paid, the report will still have the default listed (the status being changed to 'Settled'). If the debt is disputed, then a Notice of Correction needs to be forwarded to the relevant credit report body, whether it be Experian, Equifax or Callcredit. I hope you feel my advice has helped you. Canada's 911: Government was warned about Air India Bombing The inquiry looking into the 1985 Air India bombing will be told Monday that government agencies were warned a number of times an airline attack was imminent, the CBC has learned. The official line has been that the government knew of no such information, a key issue for the victims' families. Many of them testified last fall that Canadian law enforcement agencies had to know much more than they've let on, the CBC's Terry Milewski reported Sunday. But the inquiry — resuming Monday after lengthy wrangling over official secrecy — is about to hear of a months-long series of specific warnings about a coming attack on Air India. The warnings came from police informers, the Indian government and Air India itself, which told the RCMP three weeks before the bombing that Sikh extremists in Canada were planning to put bombs on Air India flights, Milewski reported. Hints of all this emerged in a censored version of a top-secret 1992 report prepared by a parliamentary committee, which described many warnings and concluded: "There is no doubt that the government of India warned Canada on a number of occasions that Air India operations were about to be attacked." Airline failed to check bags On Monday, the inquiry will hear that the RCMP failed to give details of the Indian intelligence to the Canadian Security Intelligence Service, and that the airline itself failed to check bags against passengers, allowing an unaccompanied bag on to the plane, Milewski reported. Furthermore, several police informers inside the Sikh extremist movement also reported the bomb plot. Paul Besso told CBC News he was spying on Sikh drug dealers when he heard about the plot. "I was wearing a body pack and my van was wired so the RCMP actually have a transcript of a tape telling them of a plot against Air India days to a week before it happened," Besso said. CSIS also followed the plot leader, Talwinder Singh Parmar, to a test bombing on Vancouver Island, just three days after the tip from Air India about the bombs. Vancouver police also monitored a meeting of Sikh militants, where one can be heard complaining that: "No ambassadors have been killed! What are you doing? Nothing!" "You will see! Something will be done in two weeks," another person replied. Informer overheard warning At the same time, an informer at a Sikh temple in Malton, Ont., reported that Sikhs were being warned it would be unsafe to fly the weekly Air India Flight No. 182. Since the bombing, Canadian governments have insisted the threat wasn't clear. In 1987, then solicitor general James Kelleher said: "I should point out to the House that there was no indication that there was a specific threat to Flight 182." In 2003, then solicitor general Wayne Easter said: "They were not in a position to know that there would be a terrorist attack on an Air India aircraft." Under the proposed changes, law enforcement agencies would be allowed to target groups and individuals on the basis of suspicion of participation in terrorist acts or providing material support to terrorists. Former FBI agent and American Civil Liberties Union policy counsel Michael German, however, told the Washington Post that the proposed changes could lead to abuse of constitutional rights by law enforcement agencies, citing cases where police have eavesdropped on political dissenters and infiltrated their ranks. "It turns police officers into spies on behalf of the federal government," German said. "If police officers no longer see themselves as engaged in protecting their communities from criminals and instead as domestic intelligence agents working on behalf of the CIA, they will be encouraged to collect more information." The real intent of the changes, Olbermann opined, is to implement them before President Bush leaves office "so the next president can't do a damn thing about unraveling this disaster, which is, appropriately enough, an embryonic police state." On Monday, the Senate Judiciary Committee called on Attorney General Michael Mukasey to delay the implementation of the new guidelines, which would take effect October 1, until FBI Director Robert Mueller has a chance to testify to the Committee on September 17. "Efforts to harmonize the rules governing criminal and national security matters also raise potential civil liberties concerns," said Committee chairman Sen. Patrick Leahy (D-VT) and Ranking Member Sen. Arlen Specter (R-PA) in a letter to Mukasey, "given the broader latitude currently given to investigators to consider race and ethnicity in national security matters." Tsunami Thailand 2004 Indian Ocean earthquake was an undersea earthquake that occurred at 00:58:53 UTC (07:58:53 local time) December 26, 2004, with an epicentre off the west coast of Sumatra, Indonesia. Surprisingly, some islands right in the middle of the tsunami were not badly affected. It turns out their atolls, or coral reefs, absorbed much of the wave. The coral ridges protected them. In many regions of the Asian waters, there is a practice some fishermen use, of dynamiting the natural coral reefs to bring up fish. These barriers to the tsunami were no longer in place to deflect the water. The disaster promoted a global outpouring of sympathy, with governments, individuals and corporations pledging more than $13 billion in aid. According to UN database, nearly two years after donors pledged billions to help the victims only half the money had been spent. Of the half a million people left homeless by the disaster, only a third have been permanently rehoused. The public response to the tsunami was very untypical. A combination of events - the dramatic nature of the huge wave, its occurrence at Christmas, the size of the disaster, the fact that so many Westerners died, the availability of spectacular video footage and the extensive TV coverage that secured - meant that the global public gave far more than ever before. The money went to aid agencies that were too small to mastermind such a mammoth task. Oxfam has spent more than $280 million on disaster recovery work and is now more than three-quarters of the way through its response plan. Aid workers have helped more than 2.3 million people across seven countries to get back into their homes.Despite the outpouring of generosity from aid agencies and individuals, recipient countries say pledges by some governments have still not been honoured.
