Statutory Rapist / Unlawful Sex My client was arrested and then charged for forced rape and statatory rape. She was 16, my cleint was 22. They both worked for the same grocery store. The alledged victim portrayed herself as a sweet young girl, who was saving her virginty for marriage. However my investigation was able to proove just the opposite. She wasn't the 'virgin flying nun' that she protrayed herself to be. She led a sexually sophisticated life style. Thankfully, later in the middle of my investigation, the charge of 'rape by force' was dropped, do to a lack of medical evidence. However my cleint still faced the charge of statutory rape. The law states a person having consentual sex, must be at lease 18 years of age. My cleint advised she told him she was 19 (she lied.) My mission... to prove that it was 'reasonable' for my cleint to believe that she was in fact 18 years or older. My investigation and surveilance discovered the following. Ø The victim purshased and smoked cigarettes (you must be 18 years of age to do so.) Ø She drank alcoholic beverages (must be 21 years of age.) Ø She flirted like a permiscous adult with colleges in the work place (according to statements I took.) Other women in her work place, even warned men to stay away from her. Ø She operated machinery at work, whereas their company policy was that you must be 18 to operate. A cardboard bailer) Ø She was secretly engaged to be married to another person even older then my client. Ø And much more.... Case Results. The charge was dismissed.
