Bruce Fein Wednesday, August 20, 2008 http://washingtontimes.com/news/2008/aug/20/a-genocide-inquiry/ Bosnia has its Radovan Karadzic, Sudan has its Omar Bashir and the United States could have its Gotabhaya Rajapaksa. He is a United States citizen serving as Sri Lanka's Sinhala Buddhist defense secretary who may be complicit in an ongoing genocide against Sri Lanka's Tamils. While Mr. Rajapaksa enjoys a presumption of innocence, the United States should be investigating to ensure it is as scrupulous in genocide enforcement as is expected of foreign governments. Until Mr. Karadzic's recent capture by Serbia, the United States had imposed economic sanctions against the Serbian government for noncooperation with the International Criminal Tribunal. An additional earmark of United States abhorrence of genocide is the Office of Special Investigations (OSI) in the U.S. Justice Department. It is tasked to investigate individuals complicit in Nazi-sponsored acts of persecution who subsequently entered the United States by fraud. The guilty are denaturalized or deported. The OSI would thus be well suited to lead a genocide investigation of the defense secretary. The United States criminal code prohibits the crime, wherever perpetrated, by a United States national, green-card holder or any other person found or brought into the country. Adolf Hitler's "Mein Kampf" featuring anti-Jewish diatribes previewed the Holocaust. The parallel political dynamic at work in Sri Lanka is the Buddhist Mahavamsa combined with Buddhist monk teachings that non-Buddhist Tamils must be exterminated to honor Buddha's vision of an ethnically pure Sri Lankan state. As recently as July 20, 2008, AFP news service quoted Mr. Rajapaksa's close colleague, Lt. Gen. Sarath Fonseka, as describing Sri Lanka as a "Sinhala nation" to the exclusion of Tamils. That exclusionary concept is reminiscent of Hitler's ambition to make Nazi Germany "judenfrei," or free of Jews. And just as Hitler's Waffen SS was pure Aryan, the Rajapksa-Fonseka Sri Lankan armed forces are virtually pure Sinhala. An investigation of Defense Secretary Rajapaksa would seem amply justified by the benchmarks of the Karadzic or Bashir indictment or arrest warrant. All three are potentially culpable under the time-honored doctrine of command responsibility. Generally speaking, it imposes criminal liability on government superiors who either knew or had reason to know of war crimes by subordinates and neglected to take reasonable measures to prevent or to punish the perpetrators. Mr. Karadzic confronts a trial for, among other things, genocide of thousands of Bosnian Muslims at Srebrenica before the International Criminal Tribunal for the former Yugoslavia. On July 14, 2008, Luis Moreno-Ocampo, prosecutor of the International Criminal Court, applied for an arrest warrant against President Bashir. The application accused him of genocide by killing, raping and starving members of the Fur, Masalit and Zaghawa ethnic groups. The prosecutor specially emphasized that President Bashir "denies victims [of genocide] access to the criminal justice system, while using the system against those who did not comply with his genocidal orders. [He] protects, promotes and provides impunity to his subordinates, in order to secure their willingness to continue committing crimes. He could authorize investigations of members of the armed and security forces, but the only officers investigated are those who refuse to participate in crimes." Prosecutor Moreno-Ocampo concluded: "Al Bashir's motive was control of power. His pretext was a 'counterinsurgency.' His intent was genocide." 'APRC ineffective' advisor resigns http://www.bbc.co.uk/sinhala/news/story/2008/03/080303_jayampathi.shtml The present parliament of Sri Lanka is incapable of finding a political solution to the ethnic problem, says a leading constitutional expert who stepped down from the post of senior advisor to the Sri Lankan Government. Dr. Jayampathy Wickramaratne sayS that he completely lost faith on the All Party Representative Committee [APRC] formulated by the government to find a political solution to the ethnic problem. Resigning from his post as a senior advisor to the ministry of constitutional affairs, Dr Wikramaratne said that the government is not interested in devolving power to the Tamil people. Dr Wikaramaratne said, "when APRC was appointed I was hopeful that something tangible would come out form it". Hopes are receding "Given the composition of this parliament and the disproportionate share of seats that the Janatha Vimukthi Peramuna( JVP ), Jathika Hela Urumaya (JHU) and Mahajana Eksath Peramuna (MEP) have relative to their actual support, I do not think much can happen with in this parliament". "My hope that some thing tangible would come is receding and therefore the time has come to move out of the ministry" Dr. Wikramarathne added. Dr. Wickramaratne is a senior member of the government coalition partner Lanka Sama Samaja Party [LSSP]. He said that LSSP was ambitious about finding a solution to the ethnic problem within the framework of APRC and led the venture to propose recommendations to the APRC. According to Dr.Wikramaratne, his LSSP colleague Minister Tissa Vitharane who chaired the APRC has promised to put forward proposals to devolve powers to Tamils, despite the opposition from JVP, JHU and MEP. However, Minister Vitrarane ended up by being party to the "diluted 13th amendment" said Dr.Wikramaratne. 13th Amendment "If the LSSP and the Communist Party of Sri Lanka stood steadily for the devolution, without being submissive, we would have been able to achieve a political solution," Dr Wikramaratne pointed out. He said that the LSSP "does not have any problem with fully implementation of the thirteenth amendment." Dr. Jayampathi Wikramaratne first joined the ministry of constitutional affairs as a consultant in 1996 and was instrumental in preparing the constitution reforms bill presented in 2000 under the Chandrika Bandaranaike government. He served in the US Justice Department under President Reagan and has been an adjunct scholar with the American Enterprise Institute, a resident scholar at the Heritage Foundation, a lecturer at the Brookings Institute, and an adjunct professor at George Washington University. He is an advisor to Ron Paul. "The reason why the Kosovo independence is so significant is because it addresses an issue that's prevalent throughout the world, for example Sri Lanka, where you have a minority that has been oppressed by the majority. And we've always had rather blurry lines in knowing, well, when does the oppression reach a sufficiently intense and egregious level that you're entitled to walk away from a sovereign and establish your separate statehood?" asks Bruce Fein in a video commentary on the global significance of Kosovo independence given to U.S-based Real News Network Sunday. Excerpts from transcript of the interview follows: "I think when you force a minority to live under a brutal regime; it continues a convulsed state of affairs. And with Sri Lanka in particular, with which I'm familiar, we've had almost 50 years of oppressions of a Tamil minority at the hands of a Sinhalese majority. "At present there's indiscriminate bombing of civilian areas in the Tamil north of Sri Lanka. You've got the Rajapaksa brothers. They're the ones who run the government at present with a General Fonseka, accused of egregious human rights violations. You can commit crimes against Tamils with virtual impunity. Over decades there's been maybe or two prosecutions for disappearances for kidnappings, for arbitrary arrests, that sort of thing. "They've got preventive detention laws that make it a police state in the north where the Tamils reside. It's almost a black hole. No foreign reporters permitted there. No TV reporters. No UN presence there. No ambassadorial presence there. And the issues are always raised, Well, we cannot authorize, you know, any kind of statehood as in Kosovo, because then it will cause an unraveling of the nation state system. * Transcript of Fein Commentary "Forcing people together when it's shown over a long period of time that they don't have the homogeneity the common DNA to live harmoniously seems to me utter nonsense. It's a formula for disaster. And so the Kosovo, I think, message is we need to look at places like Sri Lanka and Iraq and other places where we've got constant convulsions, to see whether or not it makes sense to redraw boundaries. Fein concludes: "Remember the wisdom of Lord Palmerston: nations don't have permanent friends and enemies; they have permanent interests. And the interests the United States regularly is in recognizing these separatists—if you want to call them separatist moments for statehood, really, because it furthers political stability. And of course when we recognize these new states that subscribe to the principles of democracy and free enterprise, it gives us a new ally." Questions raised by the birth of a new state towards demand for self-determination by similarly affected Tamils in Sri Lanka, may explain Sri Lanka's discomfiture towards Kosovo's independence, more than the outwardly expressed "concern" for the threat to international peace and security, political observers in Colombo said. "We note that the declaration of independence was made without the consent of the majority of the people of Serbia. The Unilateral Declaration of Independence by Kosovo could set an unmanageable precedent in the conduct of international relations, the established global order of sovereign States and could thus pose a grave threat to international peace and security," Sri Lanka's statement said according to media reports from Colombo. China, Russia and India are expected to oppose the Kosovo's independence. Land-locked Kosovo, with a geographic area of 4200 sq.mile and population of 2m, will be the sixth state carved from the former Serbian-dominated Yugoslav federation since 1991, after Slovenia, Croatia, Macedonia, Bosnia and Montenegro, and is expected to be accepted as the 193rd state in the world's comity of nations. Tacit acceptance of the viability of Kosovo with a smaller geographic area than Sri Lanka's NorthEast (7500 sq.miles), and smaller population than Tamils in Sri Lanka (4m), by approving members of the international community debunks the argument against the viability of Tamileelam, political observers in Colombo noted. In contrast to Kosovo, Tamils demand for self-determination initiated by an alliance of Tamil political parties in Vaddukoaddai resolution in 1976, preceded the armed struggle by Liberation Tigers, and therefore, provides additional weight to Tamil demand. Dispute on the legality of Kosovo's independence is likely to continue between US, EU and the opposers led by Russia and Serbia. Many Western governments argue that because 1244 does refer to general principles that G8 foreign ministers had agreed in advance of the resolution, these should be used as the basis for the acceptance of independence now. These principles include the deployment in Kosovo of "international civil and security presences" and "facilitating a political process designed to determine Kosovo's future status," according to analysis by BBC. The counter-argument by Serbia and Russia will be that Serbia, the sovereign state, has not agreed to independence for Kosovo, that there is no Security Council resolution authorising the detachment of Kosovo from Serbia and that therefore its independence is illegal. Sri Lanka's foreign ministry added its voice to the dissenters saying: "This action by Kosovo is a violation of the Charter of the United Nations, which enshrines the sovereignty and territorial integrity of member states," AFP said. Sri Lanka's stand, however, ignores Article 1(1) of UN's International Covenant on Civil and Political Rights which asserts: "All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development."
